Guarantee and warranty – what is the difference?

The terms guarantee and statutory warranty are often used interchangeably, but they refer to different things.

Statutory warranty

The statutory warranty concerns the buyer’s rights against the seller if a purchased item is not contractually compliant or is faulty.

These rights arise from the applicable statutory provisions.

ℹ️ Note:
Among other things, when and from which retailer the product was purchased is decisive. If the product was purchased from a different retailer, that retailer is generally the first point of contact for claims arising from the relevant sales contract.

Guarantee

A guarantee is an additional, voluntary commitment made by a manufacturer, seller or guarantor.
What a guarantee covers is set out in its specific guarantee terms.

A guarantee may, for example, cover certain:

• products,
• components,
• periods of time, or
• types of fault.

⚠️ Important:
A voluntary guarantee does not replace or limit any existing statutory warranty rights.

• order number (if purchased through our shop)
• date of purchase
• smartwatch model
• description of the problem
• the retailer or website where the purchase was made

What is not normally considered a technical product defect?

Depending on the cause, the following types of damage, for example, may be assessed differently:

• drop or impact damage
• a broken or damaged display
• improper use
• damage caused by external factors
• normal wear and tear
• damage arising from use outside the intended purpose

Whether a claim exists in a specific case must be assessed based on the individual circumstances.
